HC seeks reply from Centre, Airtel, American Tower Corporation

Allahabad High Court has asked the Centre, telecom giant Bharti Airtel and passive infrastructure company American Tower Corporation to respond to a petition filed by a Gorakhpur resident who had challenged permission granted by the concerned authorities for installing a mobile tower in the vicinity of her residence.

A Division Bench comprising Justice Tarun Agarwal and Justice A K Sharma passed the order yesterday on the petition of Sudami Devi, a resident of Khajani tehsil in Gorakhpur who had challenged the concerned Sub Divisional Magistrate's approval for installing a mobile tower near her house.

The petitioner had contended that the SDM's order was in violation of guidelines issued by the Department of Telecom whereby it has been laid down that towers could not be installed within 100 metres of a residential building.
 

The court has granted three weeks' time to the respondents for filing counter affidavits.
