Delhi High Court today sought from the Delhi Police details of the investigation into the accidental fall of a young man from the sixth floor of Hyatt Regency here to the fourth floor over five months ago.
Justice Manmohan asked for a status report of the probe by the police and findings of the Municipal Corporation of Delhi regarding the reasons behind the accident and whether they have found any negligence on the part of the hotel.
The court sought the report from the DCP, South District, and listed the matter for further hearing on May 13.
The court called for the status report saying it wants to examine the facts of the case before it gets into the licensing issues.
The order was passed by the court on a plea filed by the sister of the young man, Gaurav Rishi, who is still in coma since his accident on the night of October 16, 2013.
The petition has sought directions prohibiting the authorities from renewing the No Objection Certificates (NOCs) or licences granted to the hotel (granted from April 1 to March 31 of every financial year) till conclusion of the investigation with respect to the alleged violation of the conditions of the licences.
Senior advocate A S Chandhiok, who appeared for the petitioner, questioned how the authorities can "mechanically and arbitrarily" renew every year the NOCs and licences granted to Hyatt when allegedly there have been "repeated occurrences of fatal and life threatening incidents" at the hotel.
The petition also seeks details of the current status of the licences and NOCs granted to the hotel.
Referring to the incident, the petition alleges that the accident occurred due to "wilful gross negligence by the management and employees of the hotel" as the victim lay seriously injured for over an hour before an ambulance came to take him away, despite the AIIMS trauma centre being less than a kilometre away.
