HC slaps fine of Rs 50K on DDA on senior citizen's plea

Justice Hima Kohli also ordered the DDA to allot Saraswati Datta another flat at Motia Khan in Central Delhi within a month in lieu of the Vasant Kunj flat, which was allotted to her after long wait but had been handed over to some one else.

On a petition by Datta, Justice Kohli also ordered a probe against the erring officials for the lapse by the DDA.

She directed the DDA vice-chairman to initiate enquiry against the officials, taking note of the inconsistencies in the DDA affidavit, filed in response to the woman's petition and the DDA records about the flat.

 

The court also issued notice to the department for its response by August 7 and allowed the petitioner to file a civil suit against the agency as the money was blocked for several years.

In her petition, filed through counsel S K Bhaduri, Datta said she had applied for the flat in Vasant Kunj under the SFS scheme in 1980 and was was declared successful after a draw of lot by the housing agency in November 1990.

Claiming that she had paid a total amount of about Rs 11 lakh in 1992 for the flat, the woman said she was asked by DDA to complete the formalities which she did.

Later, she was alloted the flat but its possession was not given to her for years and that forced her to approach the officials to hand over the flat.

In 2008, she came to know that the same flat, which was alloted to her earlier, has been alloted to some one else by DDA even without informing her or returning her money.
