Orissa High Court has slapped an interim stay on implementation of an ordinance repealing the Odisha Cooperative Societies Act which would have allowed Odisha Government to have a firm control over management of over 1600 cooperative societies and self-help groups (SHGs).

Admitting a batch of petitions, a Division Bench of the High Court comprising Chief Justice C Nagappan and Justice Indrajit Mohanti yesterday stayed the operation of the of the Odisha Self-Help Cooperative (Repeal) Ordinance of 2013.

It may be mentioned that the High Court had earlier issued notices to the state government asking the chief secretary, law secretary and registrar of cooperative cocieties to file their counters to the petitions.

It was argued in the court by the counsel of the petitions that the ordinance promulgated by the state government violates the rights guaranteed under Article 19 (1) C of the Constitution of India.

Besides, the ordinance was against the spirit of an earlier judgment of the Supreme Court delivered in 2011, they contended.
