HC stays BCI rule which bans private practise by govt lawyers

The stay was granted by division bench of Chief Justice Mohit Shah and Justice R V More, on the petition filed by Brihanmumbai Municipal Corporation (BMC) here.

The court directed that the BMC petition be clubbed and heard along with another petition, filed by Sunanda Chavare and others, which is to be decided by a larger bench.

Till then, the lawyers working as legal officers in BMC and other government organisations can continue to practice.

Chavare has challenged a clause in an advertisement issued by the High Court for the posts of district judges in Maharashtra, which says a full-time salaried public prosecutor, law officer of Central or State Governments, or of any public Corporation would not be eligible.
