HC stays CAT order

The Madras High Court today stayed

an order of the Central Administrative Tribunal, quashing conferment of IAS on Madurai Corporation Commissioner Nandgopal

Nandagopal had filed a petition against the order of the CAT, which quashed a central Government order conferring IAS on him.

A division bench, comprising Justices Elipe Dharma Rao and M Venugopal, said one of the two charges against him had not been proved whereas on the other, the Disciplinary Authority itself had stated there was no need of action as the subordinate officers have only committed mistakes. The only accusation against him was he has not supervised properly.
 

As the Disciplinary Authority itself dropped the charges, the tribunal, without analysing contentions raised on either side in a manner known to law, had allowed the application on surmises and conjectures, the bench said and quashed the CAT order.
