HC stays GO stipulating cut-off date for incentive increament

The Madras High Court bench today stayed the Tamil Nadu government order stipulating January 18, 2013 as the cut-off date for grant of incentive increment to B.T. Teachers upon acquiring higher qualifiction and for recovery of the amount paid earlier to them.

Justice S Manikumar stayed the GO and ordered issue of notice to the School Education Secretary after admitting a petition filed by P Prakasam, a B.T. Assistant of Government High School, Theni, who had challenged the notification.

The petitioner submitted the government was giving differential treatment to the B.T.Assistant, while it granted incentives to all other teachers including the P.G.Teachers who have higher qualification prior to joining the service.
 

The government had paid the incentives and now they had ordered for recovery of the same by a new clarification order, he contended.

The petitioner said his services were regularised in 2006 and he had M. Phil degree when he joined as B.T. Assistant.

The government combined M.Phil degree with M.Ed and he was given incentives to the tune of Rs 1.09 lakh, which the government is now seeking to recover stipulating January 18, 2013 as the cut-off date for extending the benefit and prayed for staying the order.
