HC stays NCSC order to lodge FIR against 4 IIT Kanpur faculty members

The Allahabad High Court has stayed the order of National Commission for Schedule Caste (NCSC) to lodge FIR against four faculty members of IIT Kanpur for causing 'atrocities' against an assistant professor belonging to the scheduled caste community.

The commission had acted upon an enquiry report of the IIT Kanpur which had conducted an enquiry in the complaint of alleged harassment of one professor S Sadrela by four faculty members of IIT.

Earlier, also the court had stayed lodging of FIR in the case but had given liberty to the administration of IIT Kanpur to conduct disciplinary proceedings against the professors in accordance with law, if they so desired.

 

After which the administration conducted an enquiry in the matter and filed its report on the basis of which the commission directed lodging of FIR.

The court issued notice to the commission and had directed the state government and the commission to file counter affidavit in the case within four weeks.

An assistant professor in the department of aerospace at IIT Kanpur S Sadrela had accused four faculty members of harassment and filed a case against them with the NCSC.

The bench comprising Justices Pankaj Mithal and Mukhtar Ahmed passed the above order while hearing a petition filed by Ishan Sharma.
