The Madras High Court today granted an interim stay on a single judge order upholding the orders of Medical Council of India to withdraw permission granted to DD Medical College and Hospital.
A Division Bench, comprising Justice M Jaichandran and Justice K Kalyanasundaram, passed the interim orders on an appeal filed by DD Medical College and Hospital of Thiruvallur district and also stayed MCI's decision to permit the State Government to encash the bank guarantee, until further orders.
The single Judge had on January 20 upheld the decision of the MCI to withdraw the letter of permission to the college on the ground that it had violated the law of the land and had cheated innocent students.

The bench, while staying the order, said the college has raised certain issues like whether the MCI and Medical University are bound to regularise the illegal admissions and whether state should be directed to take over the institution, before the Supreme Court which are pending for adjudication.
As per the materials available on record, some writ appeals are also pending before the High Court against the single judge order, the court said.
Hence the bench said "we find it appropriate to grant an interim order of stay of the decision of the Board of Governors of the MCI to withdraw the permission granted vide letter dated July 12, 2010 and its decision to permit the State Government to encash the bank guarantee until further orders.
