Allahabad High Court today stayed an order passed by the Uttar Pradesh government two months ago in which 'Kumhar' caste was included in the Scheduled Castes.

A Division Bench of Justice Ashok Bhushan and Justice Satish Chandra passed the order on a Public Interest Litigation challenging the Government Order dated January 18.

The petition challenged the order on the ground that according to the Constitution, only the Centre had the power to include any caste group in the list of Scheduled Castes.

Staying the order, the court asked the state government to file its counter affidavit stating under what provisions it had included a new caste group in the list of Scheduled Castes.
