HC turns down MLA's plea for quashing trial in murder case

The Allahabad High Court today turned down a petition filed by a Samajwadi Party MLA seeking quashing of trial against him in a 34-year-old murder case.

Justice Ranjana Pandya dismissed the criminal revision application of Vijay Kumar Mishra, who represents Bhadohi seat in Uttar Pradesh legislative assembly.

Mishra is facing several criminal cases.

He had challenged the trial proceedings in the murder of Dharnidhar Tripathi, a well-known surgeon who was shot dead inside his clinic in Mirzapur district on May 25, 1980.

The MLA had contended that since none of the witnesses in the case is alive, there was no reason to prolong the trial.
 

However, the high court was of the view that a decision in this regard should be taken by the trial court itself.

Incidentally, Tripathi's brother Rakesh Dhar Tripathi went on to become a prominent figure in state politics and was a Cabinet minister in the previous BSP government in UP.
