The Gauhati High Court has fixed December 16 as the date for hearing the case of two Congress MLAs Gabriel D Wangsu and Wanglam Sawin who resigned from the state Legislative Assembly on September 16 last.
"Their position will be cleared only after the final disposal of the case," Assembly Speaker Nabam Rebia told PTI today.
He said, the resignation letters were accepted and accordingly the Assembly secretariat issued notification on October 1.

The Speaker said the Assembly secretariat on October 20 last filed a Special Leave Petition (SLP) in the Supreme Court as the High Court did not call for recourse before pronouncing its judgement.
"The apex court has referred back the case to the High Court directing to decide the matter within two months," Rebia said adding, the Court today took up the case and fixed December 16 as the date for hearing.
Both Wangsu and Sawain immediately after acceptance of their resignation alleged they were forced to resign by Chief Minister Nabam Tuki.
The Speaker said the Winter Session of the Assembly has been summoned by Governor J P Rajkhowa from January 14 to 18, 2016.
"Accordingly, summons have been issued to all the members of the Assembly except Wangsu and Sawin whose summons are conditional as the case is sub-judice," he said.
