The Court also directed that the powers under the Motor Vehicle Act (MVA) are delegated to the police well in time and required cooperation is extended to the Mobile Traffic Magistrate Court to function effectively.
The Court also made it clear that in case the amendment to Rule 19 (8) of Himachal Pradesh Motor Vehicle Rule, 1990 regarding check on the use of mobile phones by drivers has not been promulgated it should be done within a month from today.
The Court also directed that appropriate and effective steps be taken by the Commissioner (Transport) and the DGP to see that there was no over speeding.
The division bench comprising Chief Justice Kurian Joseph and Justice D C Chaudhary passed these orders on the petition filed by one Sanjay Sood for issuing directions to the state government to take seriously the increasing accidents in the state.
The petitioner had prayed for issuing directions to the Government and Transport authorities for random and frequent checking of vehicles and drivers licenses and for stringent action to be taken against the offenders.
