House adopts bill on Shetty Comm's recommendations

Himachal Vidhan sabha today passed Himachal Pradesh Subordinate Courts Employees (pay, allowance and other conditions of services) Amendment Bill, seeking implementation of Shetty Commission recommendations regarding pay scales admissible to subordinate courts' employees with effect from April 1, 2003.

Speaking on the Bill, Chief Minister Virbhadra Singh said the non-gazetted judicial employees welfare association had filed a petition in Himachal High Court, seeking relief that the recommendations of the First National Judicial Pay Commission (Shetty Pay Commission) be implemented.

The said petition was decided by the high court vide its judgement of January 3, 2014 in favour of the association and the court quashed and set aside section 3 of the parent Act to the extent that it overrules the directions of the Supreme Court to implement the Shetty Commission recommendations.
 

The high court also directed to implement the recommendations of Shetty Commission on and with effect from April 1, 2003.

In order to comply with the directions of the high court it has been decided to amend section 3 of the act and to substitute the schedule appended to the said Act.

Further, a proviso is also proposed to be inserted below sub-section (I) of section-3 of the Act to allow one additional increment to the categories of employees to whom the Shetty Commission has not recommended higher pay scale.

The implementation of revised pay scales would entail annual recurring expenditure of Rs one crore while the total financial implications including arrears will be approximately Rs 9,43 crore.
