Informer alleges assault: Court directs fair probe

Miffed over casual police probe into a complaint filed by an informer against two excise department superintendents, a court here has asked Delhi Police Commissioner to ensure fair investigation and also take action against the negligent investigating officer and SHO.

Chief Metropolitan Magistrate Vidya Prakash passed the order after perusing the progress report of the probe into the complaint of the informer who was allegedly assaulted and illegally confined in Income Tax Office here by two superintendents of Customs and Excise department -- Devender and Virender, pressurising him not to disclose incidents of tax evasion.

The court had earlier directed DCP (Central) to personally monitor the investigation in the case as it noted that the probe seemed to be "guided by extraneous consideration" to shield the culprits.
 

It was then that a report was placed before the court detailing the steps taken by the agency in the probe but it was found to be casual by the judge.

"It is also painful to note that in the present matter where investigation is being personally monitored by DCP concerned, the SHO (IP Estate police station) has filed the report in such a casual manner and unmindful of the fact that investigation is also being monitored by the court.

"...It seems that the indulgence shown to them by the court has been taken otherwise," the CMM said.

"That being so, the court is of the view that lapses as well as the entire negligent conduct on the part of concerned IO as well as SHO concerned, should now be brought to the notice of the Commissioner of Police for taking appropriate action in accordance with the law so as to uphold the majesty of the law and in order to ensure completion of investigation of the present case in aproper and fair manner," he said.

The court has called for report from the Commissioner on November 18.
