Justice P S Gopinathan, before whom the plea came up, posted the petition to August 27 to hear the prosecution.
This is the second bail application of Jayarajan, the party's Kannur district secretary, whose earlier plea was rejected by the court.
Justice S S Sateeshchandran had on August 13 dismissed his plea saying there was widespread violence during the hartal called by the CPI-M on August 2, to protest against Jayarajan's arrest.
The court held that the violence unleased in the aftermath of the arrest had transgressed all limits causing damage to private and public property on a mass scale apart from causing injuries to several policemen.
"Such violence, if condoned, would jeoparadise the fabric of society and undermine the faith of public in the law enforcing agency and justice delivery system," the court had held.
Jayarajan and CPI-M MLA Rajesh, another accused in the case, had been charged under IPC section 118 (concealing design to commit offence punishable with death or imprisonment for life) in connection with the murder of IUML activist Abdul Shukkoor at Keezhara in Kannur district in February.
