A Florida judge has ruled that a Pakistani-American man cleared of terrorism support charges is entitled to examine hundreds of classified FBI phone intercepts as part of his malicious prosecution lawsuit against the US.
The ruling yesterday means that Irfan Khan will get up to 700 calls the FBI has resisted releasing, in part over national security concerns. Some particularly sensitive intercepts still may remain secret.
Khan attorney Michael Hanna says the calls could bolster Khan's claims that the government knew he was innocent before he was charged with conspiring to support the Pakistani Taliban terror group. Khan spent 319 days in jail before prosecutors dropped all charges without explanation.
Khan's father, Muslim imam Hafiz Khan, was convicted of supporting the Taliban and is serving a 25-year prison sentence.
