The judicial officer has moved the court of District and Additional Sessions Judge A K Chawla seeking transfer of applications filed by her former husband, who during the pendency of his divorce petition, had accused her of sending scandalous messages in violation of an undertaking given to the court.
The husband, who was also a civil judge in Haryana, had lost the job after she had made several complaints of harassment against him to the authorities.
The court has fixed October 5 for hearing her transfer plea.
Amit Sahni, the counsel for the former Haryana judicial officer, said "the applications pending in the court of ADJ pertain to contempt of undertaking given by the lady judge to the court that she would not make any unwarranted phone calls or send any messages to her ex-husband."
In her transfer petition, the lady judge said she has "nothing personal" against the judge but "due to the manner in which the judge had dealt" with her erstwhile husband's divorce petition, she has been constrained to seek transfer of the case from that judge's court.
"A bare perusal of the record would show that the proceedings before the ADJ have been consistently marred by judge's personal bias against her," she said in her transfer petition.
She also alleged that "the ADJ had hurriedly decided the divorce petition in favour of her husband and despite the case being decreed in his favour, the frivolous and malicious applications filed by him have been kept pending for more than two years, thereby furthering the agenda of the respondent in using them as a tool of offence against her and to keep a sword hanging on her head."
