Kids of woman accident victim get over Rs 69 L compensation

Two minor children of a 32-year-old woman, who died in a road accident in 2012, have been awarded a compensation of over Rs 69 lakh by a Motor Accident Claims Tribunal (MACT) here.

MACT Presiding Officer Deepak Jagotra, while noting that victim's husband (petitioner) expired during pendency of the proceedings, directed the National Insurance Company to pay Rs 69,28,728 to their minor son and daughter, after they attain majority.

While awarding the compensation, the tribunal relied on the testimony of the woman's husband during the proceedings that he was riding a scooter on which his wife was sitting pillion when a negligently driven Hyundai i20 car hit them from behind leading to her death.
 

"It is amply clear that the car driver must have easily seen as to who is going ahead of him. Testimony of victim's husband is absolutely believable and has not been discredited by the respondents (driver and insurance company)," it said.

"Since the victim's husband has also expired, his share will be divided into his children and his mother," it added.

The tribunal also relied on the documents including FIR, chargesheet, mechanical inspection report and post mortem report of the victim while deciding the case in favour of the victim's family members.

During the pendency of proceedings the tribunal had, in February 2013, awarded an interim compensation Rs 50,000 to the family of the victim.
