Family members of a 24-year-old youth, who died after being hit by a rashly driven car, have been awarded a compensation of over Rs 25 lakh by a Motor Accident Claims Tribunal (MACT) here.
MACT Presiding Officer K S Mohi directed Oriental Insurance Company Ltd, insurer of the car involved in the accident, to pay a compensation of Rs 25,15,800 to parents, wife and a minor son of victim Vipin Sharma, who was riding a motorcycle when he was hit by a Maruti Swift car in 2013.
The tribunal, while awarding the compensation to victim's family, relied on the testimony of an eye-witness and documents submitted by the petitioners, including FIR, post mortem report and mechanical inspection report.

According to the petition filed by victim's wife, on September 3, 2013, Sharma, a resident of Fateh Pur Beri in south-west Delhi, was riding his motorcycle when a rashly driven car hit him from behind due to which he suffered fatal injuries.
He was taken to a private hospital in Chhatarpur where he was declared as brought dead.
Sharma, who was working as a carpenter, is survived by his parents, wife and a minor son.
During the proceedings, the driver and owner of the car did not file any written statement, however, the insurance company made a legal offer to the family members of the victim, which was turned down by them.
The insurance company had also claimed that the accident occurred due to the contributory negligence of the victim who jumped the speed breaker. This claim was rejected by the court saying the company neither lead any evidence nor file any written statement taking the plea of contributory negligence.
