Kin of road accident victim given Rs 36.91 lakh compensation

Family members of a 32-year-old auto driver, who died in a road accident involving a rashly driven car, have been awarded a compensation of nearly Rs 37 lakh by a Motor Accident Claims Tribunal (MACT) here, raising the amount sought by the victim's kin.

MACT Presiding Officer Sanjeev Kumar Singh directed the Reliance General Insurance Company Ltd, insurer of the offending Indica car, to pay Rs 36,91,000 to the wife, six children and parents of the victim Naseem Khan who died in the accident last year.

The tribunal, while deciding the petition in favour of the victim's kin, relied on the testimonies of his wife and an eyewitness who said that Khan was driving an autorickshaw early in the morning on January 2, 2014 when he got hit by the speeding car and died on the spot.
 

It also relied on the FIR lodged against the driver and the mechanical inspection report of the car.

According to the petition, filed by family members of the victim, on the fateful day, Khan was going in his three- wheeler from Azadpur Mandi here towards ISBT, when an Indica car, driven in a rash and negligent manner, hit his vehicle leading to his death.

The petition had sought a compensation of Rs 25 lakhs on account of fatal injuries sustained by Khan in the accident.

In their written statements, the driver and owner of the car had denied the rash and negligent aspect and also termed the contents of the petition as false, while the insurance company admitted that the offending car was insured with it on the date of the accident.
