Family members of a man, who died in a road accident in 2011 after being hit by a rashly driven bus, have been awarded a compensation of over Rs 40 lakhs by a motor accident claim tribunal (MACT) here.
The tribunal directed ICICI Lombard General Insurance Company Ltd, with which the offending bus was insured, to pay a total compensation of Rs 40,15,183 to the kin of 47-year-old Rameshwar Chaudhary who was on his two-wheeler when accident took place in July 2011.
MACT's Presiding Officer Ajay Kumar Jain relied on the testimony of an eye witness, Rupender Singh, who said that the offending bus had hit Chaudhary's two-wheeler from behind and the victim was crushed to death.
"Hence, the petitioners are awarded a total amount of Rs 40,15,183," the tribunal said.
The order came on a petition filed by the family members of Chaudhary seeking compensation on the ground that he had died in the accident due to the rash and negligent driving of Jagdish Kumar, the driver of the bus.
The petitioners had told the tribunal that Chaudhary was going to his office on July 12, 2011 and when he was near Noida City Centre, the offending bus came from behind and hit his motorcycle due to which he fell down and died on the spot.
During the adjudication of the petition, Rupender Singh had told MACT that on the day of accident, he was driving his two-wheeler behind Chaudhary's bike and he saw that the bus coming from behind and hitting Chaudhary's motorcycle due to which he fell down.
The owner and driver of the vehicle had denied before the tribunal that the accident took place due to rash driving but MACT awarded the compensation, observing that Chaudhary had suffered fatal injuries due to rash and negligent driving of Jagdish Kumar.
