Kin of road mishap victim get Rs 43.31 L compensation

The family members of a man, who died in a road accident in Haryana in 2010, has been awarded a compensation of over Rs 43 lakh by a motor accident claims tribunal (MACT) here.

The MACT directed Reliance General Insurance Company Ltd, with which the offending truck was insured, to pay a total compensation of Rs 43,31,777 to the kin of 39-year-old Dharambir, who suffered fatal injuries after his two-wheeler collided with the negligently parked vehicle.

"Hence, total compensation payable to the claimants would be Rs 43,31,777 which shall be payable..." MACT Presiding Officer Arun Bhardwaj said.

Dharambir's wife and their two minor children had approached the tribunal seeking Rs 80 lakh as compensation.
 

They told the tribunal that on March 6, 2010, Dharambir while riding on his motorcycle in Jhajjar area of Haryana had collided with the truck parked on the wrong side of the road without any indicators or blinking lights on.

As the truck was negligently parked, Dharambir hit the vehicle and suffered fatal injuries, they said.

A witness, Sachin, who along with another person was behind Dharambir's motorcycle, told the MACT that the truck was parked in a negligent manner and its indicators were not switched on.

The lawyer appearing for the driver and owner of the truck had claimed that the truck was parked correctly on the road with its blinkers on.

The driver and owner of the truck had also claimed that the accident took place due to Dharambir's negligent driving.

The tribunal, however, awarded the compensation saying despite Sachin's cross examination "nothing could be elicited from him to show that the accident had taken place due to negligence of the deceased himself".
