Justice Soumen Sen, granting leave to KoPT to file the application, directed that the matter would appear before a regular bench after the Puja vacation.
In a turn of events last Friday, though the KoPT counsel did not press the matter before the court and submitted that the application be allowed to be withdrawn or dismissed, KoPT authorities later in the day issued a press release stating that it was seeking recall of the order.
The release had said that there was no instruction to the senior counsel for withdrawal of the application of KoPT in connection with the writ petition filed by HBT.
KoPT counsel Biswarup Gupta had submitted before Justice Sambuddha Chakraborty that its application for a direction to HBT had become infructuous and be allowed to be withdrawn as the cargo handler had informed the port authorities it would not continue operations at the Haldia Dock Complex.
He had also stated that the issue would be taken up at a different forum.
Cargo handling company Haldia Bulk Terminals, jointly promoted by ABG group of India and French logistics company LDA, had on October 31 announced its immediate exit from West Bengal's Haldia port citing unsafe work condition.
