Loharia murder case: HC grants bail to estate agent

The Bombay High Court today granted bail to real estate agent and developer, Sumeet Bachewar, arrested for hatching the conspiracy to murder builder Sunil Loharia.

While Bachewar was granted bail on a surety of Rs 50,000 by Justice Abhay Thipsay, Justice R P Sondur-Baldota dismissed the anticipatory bail application filed by co-accused and builder Suryaprakash Agarwal.

Loharia had in his dying declaration to his son Sunny Loharia mentioned Bachewar, Agarwal and two others - Suresh Bijlani and Anurag Garg - as suspects behind the firing.

Justice Thipsay, while granting bail to Bachewar said, "The deceased and his son had suspected that the applicant (Bachewar) was behind the firing. Suspicion may be good enough for arrest but just based on suspicion the accused cannot be detained till completion of trial."
 

Justice Baldota, however, dismissed Agarwal's anticipatory bail plea.

Loharia was shot dead in February and of the four accused only Bachewar was arrested.

According to the police, the four accused hatched the plan to kill Loharia due to business rivalry. Bachewar had come in contact with Loharia in 2005 and did several projects with him. However, in 2010 their partnership soured after which Bachewar joined hands with Bijlani and Garg who were already Loharia's rivals.

According to police, the shooter was promised Rs two lakh for the murder.
