MACT awards Rs 25L to kin of labourer killed in road mishap

A Motor Accident Claims Tribunal (MACT) here has awarded over Rs 25 lakh to the kin of a labourer who was killed in a road mishap involving a rashly driven truck in north-west Delhi two years ago.

MACT Presiding Officer Manish Gupta directed SBI General Insurance Company Ltd, insurer of the offending vehicle, to pay Rs 25,00,735 to the family of victim Dinesh Kumar, who was riding on the pillion of a bike that was hit by the truck from behind.

"From the overall facts and circumstances and evidence on record, it is clear that the accident in question occurred due to rash and negligent driving of the offending vehicle (truck)," the tribunal said while awarding the compensation.
 

According to the complaint filed by victim's wife, 37- year-old Kumar met with an accident while travelling to Rewari on September 16, 2014, while riding pillion on a motorcycle. Kumar suffered injuries when the truck hit the bike from behind and succumbed at a hospital.

The court, after considering that Kumar was the sole bread winner of his family, which comprised his wife, three children and his mother, directed the insurance company to pay the amount to them.

During the proceedings, no defence evidence was led by the accused driver and insurance company.
