MACT awards Rs 43L to man in vegetative state after mishap

The Motor Accident Claims Tribunal (MACT) here has awarded over Rs 43 lakh to the family of a man, who suffered severe head injuries in a road mishap leaving him in an "almost vegetative state".

"The injuries suffered by the injured has made his life almost vegetative and he is totally confined to bed and dependent upon others even for his daily activities," MACT presiding officer Naveen Arora observed.

34-year-old Hauz Rani-resident Israr Ahmad met with the accident on August 21, 2012 near Sikri village in Faridabad when the offending bus hit his motorcycle from behind.

The tribunal relied upon a witness' statement which said the offending vehicle came in a rash and negligent manner, hit the motorcycle and injured Ahmad.
 

The court also found that the offending bus was plying through the area where it had no valid route permit at the time of the accident and was in violation of the insurance policy.

Hence, the court directed the insurance company to pay the compensation and recover the amount from the owner of the offending vehicle.

The tribunal after considering the age, job, dependency, medical expenses incurred, as well as pain and loss suffered by the injured and his family, arrived at the compensation amount of Rs 43,61,800.
