The two are expected to be charged for breaching a court order barring the public from entering the Independence Square in the downtown area during an April 28 demonstration by an NGO, Bersih, demanding fair elections.

A section of the demonstrators had crossed the barricades and entered the square, leading to arrests, firing of teargas and water cannons.

The two are the first persons to be charged under the new Peaceful Assembly Act.

According to a writ of summons served to Azmin, he is accused of violating sections of the Penal Code which refers to "disobedience to an order duly promulgated by a public servant", and on abetting and incitement.

The notice to Azmin said he and five others had conspired with some others to breach a court order issued by Magistrate Zaki Asyraf Zubir on April 26.

Azmin is accused of abetting and inciting the others to breach the barricade around the Independence square.

A separate notice lists a charge under the Peaceful Assembly Act 2012, noting that Azmin participated in a street protest with the intention of violating Zaki Asyraf's court order.

Anwar's lawyer Sankara Nair said the two have been asked to appear at Magistrate's Court in Kuala Lumpur tomorrow.

Anwar and Azmin were accused of inciting the crowd to breach the barricade after video clips of the two gesturing at each other in front of the historic site emerged, local media reports said.
