A government employee has been asked to pay Rs 18,000 per month as maintenance to his estranged wife and daughter by a Delhi court which also restrained him from committing any act of violence against them.
The court also restrained the man, a resident of Laxmi Nagar in East Delhi, from alienating a property, which is jointly held by the couple without the woman's consent.
Metropolitan Magistrate Vandana Jain directed the man, working as an artist with Municipal Corporation of Delhi, to pay Rs 9,000 per month each to his wife and 23-year-old daughter.
The court rejected the contention of the man that his daughter has attained majority and was not entitled for maintenance, saying he has to maintain her as she was sick.
"As regards the protection order is concerned, since the complainant (woman) has proved that the respondent (man) beats her, he is restrained from committing any act of domestic violence against the woman and her daughter in any manner whether verbally, physically or mentally whatsoever from the date of the order.
"Since the man has admitted that the property at Ganesh Nagar, Delhi is in the joint name of the woman and the man, he is restrained from alienating the said property without permission and written consent of the complainant. He is further restrained to deal with his share of the property separately without the consent of the woman," the court said.
The court passed the order on the complaint filed by the woman seeking maintenance from her husband on the ground that he started neglecting her and their daughter and son since 1997 and used to torture them. After consuming alcohol, he also used to beat the woman and their daughter.
