Man convicted for conspiracy to eliminate senior lawyer

A man has been sentenced to nearly five years in jail by a Delhi court for firing at policemen and conspiring to eliminate senior counsel Siddharth Luthra, a former Additional Solicitor General.

Additional Sessions Judge Daya Prakash sentenced Nafisul Hassan to imprisonment for four years and 10 months, the period he has already spent in jail during pendency of the trial, after he pleaded guilty to the offences.

According to the prosecution, from mid of June 2009 to July 5, 2009, convict Hassan along with other accused had conspired to eliminate Luthra, who was representing BJP MP Varun Gandhi in an alleged hate speech case at that time.
 

Hassan was convicted by the court under sections 307 (attempt to murder), 471 (using forged document as genuine), 186 (obstructing public servant in discharging duties), 353 (assault or criminal force to deter public servant from discharge of his duty) and 120-B (criminal conspiracy) of the IPC and under the provisions of the Arms Act.

The court did not impose any fine or penalty on Hassan keeping in view that he was in judicial custody since July 3, 2009 and belonged to a poor family.

In pursuance of their conspiracy, the accused procured a weapon and specified the target by way of recee in order to execute their plan, according to prosecution.

They gathered in a park in Defence Colony. The accused also obstructed the raiding team of special cell, comprising 18-20 police officials, who were discharging their duties as public servants and used criminal force against the cops, police said.

It said that the accused attempted to murder the police officials by firing at them.

Hassan was also held guilty of procuring mobile phone and sim card on fake documents. He was convicted under the Arms Act for possessing a loaded pistol along with six live cartridges.

During the trial Hassan, filed an application for pleading guilty of the offences.

The court sentenced him to the period already undergone by him in custody keeping in view his economic status.
