A man accused of trying to kill a policeman has been freed by a Delhi court which held that the prosecution case was "highly doubtful" and devoid of logic and reason.
Additional Sessions Judge Vimal Kumar Yadav acquitted Sahadat Ali, a suspected criminal who had allegedly fired at a cop, of the charges of attempt to murder, obstructing public servant in discharge of functions and assaulting a public servant to deter him from discharging his duty under IPC and various provisions of the Arms Act.
"The case of the prosecution is highly doubtful and full of such circumstances which do not appeal to the logic and reason, therefore, same cannot be accepted and acted upon. As a result, the accused (Ali) is given the benefit of doubt and acquitted of the charge," the judge said.
While acquitting Ali, the court noted that there was no public witness to support the prosecution case and there were contradictions in testimonies of the police witnesses.
"The police witnesses have deposed in a parrot-like manner that a secret information was received which was worked upon leading to the apprehension of Ali. Absence of any serious efforts is also apparent..." the judge said.
According to the prosecution, the Anti Extortion Cell of Crime Branch, Delhi Police, got a tip off that a notorious criminal of Uttar Pradesh, who had several extortion and robbery cases pending against him, was coming to Delhi via Noida in a Maruti 800 on September 6, 2006.
Following this, a team of policemen laid a trap for him near Jamia Islamia Madarsa in Jamia Nagar here and on spotting the car, they tried to stop it.
On seeing the policemen, Ali, who was sitting next to the driver of the car, jumped out and tried to run away. Several policemen chased him and Ali allegedly fired at a cop.
After a few minutes of cross-firing, Ali was apprehended by the police.
