Man gets 11 yrs jail for possessing smack

A man has been sentenced to 11 years rigorous imprisonment by a Delhi court for possessing 300 grams of smack in 2012.

Special judge Shail Jain awarded the jail term to Delhi native Avinash Rathi and also imposed a fine of Rs one lakh on him after holding him guilty under the provisions of the Narcotic Drugs and Psychotropic Substances (NDPS) Act.

"I am of the opinion that prosecution has proved its case beyond reasonable doubt that accused was found in conscious possession of 300 grams of smack.

"Considering the fact that the quantity of smack recovered from the possession of convict is commercial quantity..., previous antecedents of convict, family circumstances in which he has to live, Avinash Rathi is sentenced to rigorous imprisonment for 11 years," the court said.
 

According to the prosecution, on February 2, 2012, police got a tip-off that a person would be coming at Filmistan Cinema Hall, Jhandewalan Road here for supplying smack to someone.

On receiving the information, the officers of the raiding party laid a trap and nabbed him with the smack.

During the trial, Avinash sought leniency on the ground that has to look after his family as he was the sole bread earner.
