"The act of the convict in attempting to kill the complainant, is ghastly and cannot be countenanced by any argument," Additional Sessions Judge Rajeev Bansal said while sentencing south Delhi resident Mukesh after her daughter, who was then in Class X, testified againt him during the trial
While holding the man guilty, the court also considered the "history of matrimonial litigations between the parties".
During the trial, the daughter of the victim and the accused narrated in the court that on April 3, 2010 she was sleeping in her mother's room when her father came there and started abusing and beating up her mother.
She said her father uttered the words "I will not spare you today" and thereafter strangulated her with a 'chunni' following which her mother became unconscious.
The girl said when she raised an alarm, her father left the room and then she called the police and her uncle who rushed her mother to the hospital.
"Recitation of these words (I will not spare you), coupled with the act of tying 'chunni' around the neck of the complainant and strangulating her, shows the accused had the necessary intention to kill the complainant," the ASJ said while sentencing Mukesh to five years imprisonment and imposing a fine of Rs 5,000 oon him.
The victim also told the court that she married the accused 16 years ago. She said three months after the birth of their daughter, she went to her parent's house and Mukesh filed a divorce case against her. More
