A man, who was severely injured after being hit by a rashly driven bus in 2006, has been awarded a compensation of over Rs 14.6 lakh by a Motor Accident Claims Tribunal (MACT) here.
MACT Presiding Officer Barkha Gupta directed the National Insurance Company, with which the offending bus was insured, to pay Rs 14,67,793 to Ghaziabad resident Kabindra K Sharma, who was hit by the bus while travelling on his motorcycle.
"It is shown and rather proved on record that respondent no. 1 (bus driver) was rash/negligent at relevant time while driving the offending vehicle and caused the accident," the tribunal said.
"In the given facts and circumstances and on the basis of material as placed on record, National Insurance Company (respondent no. 3) is, accordingly directed to deposit the awarded amount of Rs 14,67,793...To the petitioner and his counsel....," it said.
Sharma told the tribunal that the accident took place on September 4, 2006, when he along with his friend was going on his motorcycle from Madhuban Chowk towards ISBT.
When they reached Mukarba Chowk bypass, Sharma was hit by a whiteline bus being driven by Udai Singh at a traffic signal.
Due to the impact, Sharma and his friend fell down and the victim came under the wheels of the bus due to which he sustained injuries and was taken to a hospital, he said.
Sharma, who was working as an accountant, had sought a compensation of Rs 25 lakh submitting that he had suffered permanent disability due to the accident.
The bus driver and owner, in their written statements, had claimed that the accident took place due to the negligence of the motorist.
The tribunal, however, rejected their contention and said there was nothing on record to show that the accident took place due to the victim's negligence.
