A man has been sentenced to 10 yeas rigorous imprisonment and slapped with a fine of Rs one lakh by a Delhi court for possessing 100 kg ganja.
Special NDPS Judge Shail Jain awarded the jail term to Sumit Rai, a resident of Nangloi here, saying the forensic report showed that the contraband was ganja and recovery of the drug from his possession has been sufficiently proved.
"The samples were sent to FSL within reasonable time. Result of FSL proves the contraband to be 'ganja'. For these reasons, the recovery of ganja from the possession of the accused has been sufficiently proved," the court said.
"Rai has been convicted for the offence punishable under provision of the Narcotic Drugs and Psychotropic Substances (NDPS) Act, 1985. Considering the fact that convict Sumit Rai was found in possession of 100 kg ganja, which is commercial quantity, Rai is sentenced to rigorous imprisonment for 10 years and to pay fine of Rs one lakh," it said.
According to the prosecution, Rai was found possessing 100 kg of Ganja on the morning of April 27, 2013 at a railway bridge in Delhi. The police had got the information about Rai through an informer and he was arrested by the raiding team.
The prosecutor sought imposition of severe punishment, saying such kind of offences are on the rise in the society.
Rai, a native of Bihar, pleaded innocence and claimed that he has been falsely implicated in the case and nothing was recovered from his possession.
While convicting Rai, the court relied on the statements of police officials saying the testimonies inspire confidence and the depositions are duly corroborated with the documents.
"Their testimonies remained unshaken during cross examination and no concrete reason has been attributed to them for false implication of the accused," the court said.
The court also rejected the argument of the amicus curiae, who was representing Rai, that no public witness has been joined in the investigation.
The judge said it was settled preposition of law that merely for the reason that no public person joined the raid, the testimony of police officials cannot be disbelieved.
