Man jailed for 15 yrs for possessing drugs

A man has been sentenced to 15 years rigorous imprisonment by a Delhi court for possessing over 21 kg of banned drugs.

Special NDPS Judge Shail Jain awarded the jail term to Saidulla Ansari, a resident of Bihar, and also imposed a fine of Rs 1.5 lakh on him after holding him guilty under the provisions of the Narcotic Drugs and Psychotropic Substances (NDPS) Act.

"The convict (Ansari) has been convicted for the offence punishable under provision of NDPS Act. Considering the family circumstances of convict and the fact that convict was found in possession of 21.5 kg of charas, which is 21 more than commercial quantity (weighing one kg or more), convict Saidulla Ansari is sentenced to undergo rigoous imprisonment for 15 years and also to pay fine of Rs 1.5 lakh," the court said.
 

While convicting Ansari, the judge said, "I conclude that testimony of prosecution witnesses is consistent and trustworthy. The recovery of controlled substance from the possession of accused is clearly established.

"Ansari was found in conscious possession of 21.5 kg of charas. Therefore, accused is found guilty under the provision of the NDPS Act for having possession of charas."

According to the prosecution, police got an information that on September 19, 2012, a person would be coming towards ISBT, Kashmere Gate for supplying charas to someone.

A raiding police party reached the spot near ISBT and caught Saidulla Ansari, who was carrying two bags. During his search, he was found carrying contraband items in his bags and was arrested. The weight of the charas packets was 17.5 kg.

The prosecutor had argued that severe punishment should be imposed on Ansari as such kind of offences were on the rise in the society and he was found possessing huge quantity of charas.

The counsel for the convict had sought a lenient view towards him on the ground that he was the sole bread earner of the family and has to support his wife, three minor kids and aged parents.
