Additional Sessions Judge Yashwant Kumar sent East Delhi resident Sarfuddin to jail, upholding a magisterial court's judgement which had convicted him under section 138 of the Negotiable Instruments (NI) Act and had sentenced him to pay Rs 8.5 lakh as fine in a month.
The magisterial court had also said that "in default of the payment of the fine in a month, he shall undergo simple imprisonment for a period of three months."
The sessions court ordered "Sarfuddin" to be taken into custody, dismissing his appeal against the magisterial court's judgement, saying the same need not be interfered with.
"I do not find any illegality or infirmity in the trial court judgement dated December 24, 2011 and order on sentence dated January 31, 2012. The appeal is devoid of any merit and the same is dismissed.
"The accused has not paid the fine amount of Rs 8,50,000 as per order on sentence. The accused is taken into custody and sent to judicial custody to serve the sentence of three months simple imprisonment," the court said.
Shahdara resident Sarfuddin had taken a loan of Rs 8.5 lakh from his friend Amar Arora and had given four cheques to him to return the loan, but all the cheques had bounced as his account had already been closed.
As Sarfuddin took no step to return the loan, Amar filed a complaint against Sarfuddin, who was convicted by the magisterial court.
