Man loses limb, hospital directed to pay for 'negligence'

A Consumer Court here has ordered a reputed private hospital and a doctor to pay compensation of Rs 4.29 lakh with interest to a man who had to undergo amputation of his leg due to their "negligence".

The District Consumer Disputes Redressal Forum in its recent order said "osteomyelitis," a bone infection, had set in on P V Thyagarayan, the complainant, due to the negligence of the hospital.

"This infection ultimately lead to the amputation of right leg above the knee level." Earlier, Thyagarayan had to have his right leg below the knee level amputated at a hospital in Uttar Pradesh after an accident in Bihar.
 

The hospital and the doctor administering treatment had failed to follow the "culture and sensitive report," and did not administer the appropriate drug, it said.

It was only because of that the complainant who was not having any infection on the date of admission later developed it. This ultimately lead to the onset of osteomyelitis which resulted in the amputation of the right leg above knee level.

"This forum has come to the conclusion that negligence and deficiency has been established against the hospital and the doctor."

The hospital and the doctor should jointly and severally pay Rs 4,29,299 with interest at the rate of nine per cent to Thyagarayan, the Forum said in its order.
