Man ordered to pay Rs 6K maintenance to wife and daughter

While asking South West Delhi resident Pawan Kumar Sharma to pay the maintenance, Metropolitan Magistrate Purva Sareen also ordered him not to communicate with his daughter, wife and her relatives or indulge in violence against them.

"In view of the facts and circumstances of the case, Rs 4000 per month is awarded in favour of the petitioner (wife) and Rs 2000 per month to petitioner's daughter to be deposited by Pawan Kumar Sharma.

"The respondent is hereby restrained (from) attempting to communicate in any form, whatsoever, with the aggrieved persons... And causing violence to the dependants, other relatives or any person who help the aggrieved persons against domestic violence," the judge said.

 

The court passed the order on a plea by Sharma's wife, living separately from him. She had alleged in her plea that she was repeatedly beaten by her husband.

The woman told the court that she had married Sharma in February 2003 and alleged he, along with his father and brother, had thrashed her on November 11, 2003 for bringing insufficient dowry and cash in their marriage.

They further demanded Rs one lakh and a motorcycle from her parents, she said adding she was physically and mentally harassed by Sharma for her failure to meet their demand, following which she was compelled to leave her matrimonial house and live separately with her eight-year-old daughter.

The woman had prayed for a maintenance of Rs 10,000 per month for herself and their daughter's upkeep. The court, however, declined her plea of Rs 10,000 saying no proof had been produced by her regarding the salary of her husband who works as a peon in a government organisation.
