Man sentenced to 4 years rigorous imprisonment under NDPS Act

A man has been sentenced to four years' rigorous imprisonment by a Delhi court for possessing 16 kgs of banned poppy straw in 2012.

Brijesh Yadav, a native of Uttar Pradesh, was convicted under various sections of Narcotic Drugs and Psychotropic Substances (NDPS) Act by Special Judge Shail Jain, who also imposed a fine of Rs 10,000 on the convict.

"Considering the fact that the convict was found in possession of 16 kgs of poppy straw and family circumstances in which he has to live, convict Brijesh Yadav is sentenced to undergo rigorous imprisonment for four years and to pay fine of Rs 10,000 under the provisions of the NDPS Act," the judge said.
 

According to the police, Brijesh was arrested on November 13, 2012 when they received a tip off that the accused will be bringing some "narcotic drug" for delivering it to some person at Kashmere Gate here.

When the search was conducted, he was found to be in possession of 16 kgs of poppy straw out of which one kg was kept as sample in a white coloured polythene, the police said.

While sentencing Brijesh, the judge held, "I conclude that testimonies of prosecution witnesses are consistent and trustworthy.

"The recovery of controlled substance from the possession of accused is clearly established."

During the trial, the accused claimed innocence and contended that all the prosecution witnesses have falsely deposed against him.
