Man sentenced to two months jail, let off on probation

Additional sessions judge R K Gauba let off south Delhi resident Dalip Kumar on probation, setting aside a magisterial court's order which had awarded him two months prison term for injuring scooterist Nitin Chadha.

"There is scope for moderation in the matter of punishment. It is directed that Kumar, instead of being sentenced at once to substantive punishment, shall stand released on he entering into personal bond in the sum of Rs 10,000," the judge said.

The court also directed Kumar to pay compensation of Rs 25,000 to the victim and complainant Chadha.

The judge modified his sentence after observing that he had no prior criminal record and was not involved in any accident in the past.

 

Kumar's counsel had submitted before the judge that his client was only seeking leniency in the sentence awarded to him by the magisterial court.

According to the prosecution, Kumar on March 26, 2008, hit Chadha's scooter with his motorcycle at a red light near the Munirka subway here. It had further alleged that because of the collision, Chadha had sustained grievous injuries.

The accused, on the other hand, had argued that he was innocent and had told the magisterial court that he had been falsely implicated. The trial court, however, had rejected his argument.
