Observing that Aallianz Automobiles' act of charging more money from its customer for a CNG kit amounted to "unfair trade practice", the South West District Consumer Disputes Redressal Forum directed the Maruti dealer to pay Rs 10,000 as compensation for failing to remove the defect and Rs 2,000 as litigation cost.
"Charging Rs 38,000 for the kit, costing the Aallianz Automobiles Rs 25,000 only, amounts to unfair trade practice as defined in the Consumer Protection Act, 1986. Having failed to remove the defect in the CNG Kit, the opposite party is also guilty of deficiency in service," the forum said.
The forum's order came on a plea by Vasant Kunj resident Kaushalya, who had alleged that Aallianz had charged Rs 38,000 from her for installing a CNG kit in her new Zen Estilo car and then installed the kit through a third party, Bhagwati CNG for Rs 25,000.
She had further alleged that the kit was defective and the dealer's engineers had refused to repair it on the ground that it was not installed by them.
The dealer had said it was not engaged in selling or installing CNG kits in new vehicles manufactured by Maruti Udyog Ltd and they are not liable to repair them. (MORE)
