Amey Kasbekar (20), resident of Navi Mumbai, moved the court after the Directorate of Medical Education and Research (DMER) rejected his application.
Amey enrolled in Krishna Medical College at Karad in 2009. Later that year, he was diagnosed with acute viral infection coupled with upper respiratory track infection, and has had recurring bouts since, the petition says.
He applied to DMER in September 2010, saying that he be transferred to Lokmanya Tilak Medical College, Mumbai, on health grounds. But DMER said that transfer on such grounds was not permissible, and there was no vacancy at Tilak College.
Amey's lawyer requested the vacation bench of Justices A M Thipsay and R D Dhanuka earlier this week to grant immediate relief, as the new academic year is to commence in June.
However, the judges refused to grant any relief and posted the matter for hearing in June.
