The mother of a man killed in a road accident was awarded a Rs 8.86-lakh compensation by the Thane Motor Accident Claims Tribunal (MACT), which rejected the pleas of the victim's father and two siblings.
The tribunal, in its order issued earlier this month, accepted the opposite side's argument that the victim's father and siblings were not his dependents.
Amir Sawat, then aged 26, was killed when a tempo hit his motorcycle on the Sion-Panvel road in Thane on April 19, 2016.
The victim, who worked as a helper in a factory here, was earning Rs 12,000 per month at that time, his family had claimed.
His father Akbal Sawat (55), a rickshaw puller, mother Sanni Sawat (49), brother Iltaf Sawat (23) and sister Reshma Sawat (21) -- all residents of Siddharth Nagar district in Uttar Pradesh -- had sought compensation from the tempo's owner and insurer.
The insurance company's counsel, however, had contested the claim on several grounds, arguing that there was no proof of income of the deceased and that his father and siblings were not dependent on him.

MACT Member and District Judge R N Rokade accepted the insurer's argument and said the opposite side was liable to pay Rs 8.86 lakh to the mother of the deceased, along with 8 per cent interest per annum from the date of the filing of the claim.
"The insurance company shall pay the amount to the mother of the deceased and then recover the sum from the tempo owner," the judge said in his order.
