MSU directed not to give approval for admission of 17 students

Madras High Court bench here today directed Manonmaniam Sundaranar University not to give approval to the admission of 17 students admitted to its overseas study centre in United Arab Emirates in 2011-12.

Disposing a petition filed by M Sadasivam, who had entered into an MoU with MSU for offering various courses under the Distance Education Programme to non-resident Indians in UAE, Justice S Nagamuthu also directed the university not publish results of the annual examinations written by the these students on the basis of court's interim order.

The petitioner said he had admitted 20 students for B.Com, BBA and BCA courses in 2010-11.
 

In 2011-12 he admitted a total of 17 students in various courses.

After a few months the MSU terminated the agreement with the petitioner following Supreme Court rulings which expressed concern over universities establishing study centres beyond their territorial jurisdiction. They also did not allow the 20 students enrolled by the petitioner to participate in the examination.

The petitioner obtained periodical interim orders for the 20 students to write the examination on the condition that their results would not be published.

The Judge said the students who were admitted in 2010-11 alone would be allowed to complete their courses and obtain certificates since similarly placed students had been granted such relief by the High court in another case.

The admission of 17 students could not be held valid.

The judge said the petitioner could seek legal remedy if he wanted for the loss of reputation and mental agony due to sudden termination of the agreement.

The Judge said the 17 students also were at liberty to work out remedies for the damages against the petitioner or from the MSU if they were so advised so and have got such a legal right.
