In the wake of Gujarat High Court order regarding the PIL filed by Bhatt, the state government had submitted some documents pertaining to 2002 post-Godhra riots before the Nanavati Commission.

Some of the documents, asked by Bhatt and produced after almost 10 years, were marked either 'secret' or 'confidential'.

Out of 47 documents sought by Bhatt, 17 were not produced, 25 marked secret or confidential while Bhatt had been allowed to inspect only 5 documents.

The judicial panel in a note to Bhatt had informed him that "As regards, other (those 25) documents the state has marked them as secret/confidential and it is mentioned by the state that the same may not be disclosed to any person".

"The commission has informed me that as state has mentioned not to disclose these documents to any person, an appropriate order in that behalf will be passed after hearing me and the state on October 29, 2012," said Bhatt.

The commission comprising Justice (retd) G T Nanavati and Justice Akshay Mehta was appointed by the state government to inquire the post-Godhra riots.
