Hearing the petition filed by Kavita Kardak, Justice Sharad Bobade and Justice Mridula Bhatkar asked the Maharashtra government and Nashik Mayor Yatin Wagh to file their replies within two weeks.

The petitioner contended that the post of the Opposition leader should have gone to the NCP, which has 20 corporators.

Shiv Sena and RPI contested the elections on their own individual strength, but after the results were declared, they joined hands to form an alliance and claimed Opposition leader's post. Together, the two parties have 22 corporators.

According to the petitioner, the two parties had formed a front after the elections and not prior to that. Hence they cannot claim the post of the opposition leader. On the other hand, NCP had 20 corporators and should have been given this post, she claimed.

In a house of 108 corporators, Maharashtra Navnirman Sena is the ruling party with 40 corporators.
