NCPCR seeks HC's direction on framing of guidelines for cops,

The National Commission for Protection of Child Rights (NCPCR) today sought the Delhi High Court's direction on framing of guidelines for police and lawyers in dealing with cases related to children.

"In the light of the facts and circumstances... It is most respectfully prayed that this court may kindly issue clarifications with regard to guidelines relating to police and direct the Bar Council of India to submit the report of the Committee constituted for guidelines relating to lawyers at the earliest," NCPCR told the court.

A bench of Chief Justice G Rohini and Justice R S Endlaw considered the request of NCPCR and said it will go through the guidelines and pass an order on November 8.
 

Earlier, the court had asked the police, hospitals, Child Welfare Committee and the media to observe restraint while handling cases like that of the two-year-old battered child fighting for her life in AIIMS.

The court had then designated NCPCR as the convenor of this Committee.

NCPCR said that it has received written suggestions from various members of the Committee. The guidelines for Police could not be finalized as the Committee has come to the conclusion that the same need clarification from this court in the light of Delhi Police's revised standing order.

"The Committee was informed by the representative from the Bar Council of India that the issue concerned was placed in the agenda of the Council meeting of the BCI...

"Subsequently, it had been communicated by Secretary, BCI vide letter that after consideration of the matter a Committee to examine the matter in detail and submit a report before the next Council meeting has been constituted and its report is still awaited," NCPCR counsel Aagney Sail said in the report.

The court was hearing a PIL filed by lawyer Anant Asthana which questioned revealing the name and details of the 15-year-old girl who had brought the two-year-old to the hospital and was being questioned by the Child Welfare Committee.

Directing the Delhi government to frame guidelines in this regard, the Bench also constituted a committee comprising representatives of the Centre, Delhi government, juvenile justice board, NCPCR, NGO working in the sphere and the media to help draft the guidelines in the matter.
