The North Delhi Municipal Corporation has been asked by an appellate tribunal to conduct a detailed survey of every farmhouse in Narela area to determine any violation of rules of master plan 2021.
The Deputy Commissioner of Narela zone has been asked by the appellate tribunal to conduct the survey. A total of 545 farmhouses come under the Narela zone.
The appellate tribunal at Tis Hazari court also asked the civic body to take action against errant officials who granted permission letters to run a farmhouse despite the property not meeting provisions of the Master Plan 2021.
The appellate tribunal issued the order while pronouncing its decision in a case related to a farmhouse run by JKS resorts, which had approached the tribunal against a sealing order issued last year by the North Corporation against it for alleged violation of rules.
Dismissing the plea, Ashwani Sarpal, Additional District and Sessions Judge and Presiding Officer, upheld the action of the corporation and directed the civic body to seal the premises of the farmhouse in Narela zone within 24 hours.
"Sale deed of the applicant says that land in question shall be used for purposes of agricultural only but it has been found to be misused for commercial activities," the order read.
The farmhouse earlier was under Najafgarh zone but since the trifurcation of the Municipal Corporation now comes under Narela zone.
Taking note also of the allegations by the appellant company that farmhouses which had not followed similar rules were still running in the area, the tribunal ordered the DC of the Narela zone to conduct an enquiry and added that "appropriate action be taken which are found to be violative of the Master Plan 2021".
Coming down heavily on the officials responsible for ensuring all rules are complied with, the tribunal observed, "Those officials who have granted permission letters to the appellant illegally and against the Master Plan 2021 provisions�should be also dealt with strictly at departmental level by initiating departmental action after suspending them."
The DC will have to submit the action taken report within seven days besides submitting other status reports as and when directed.
