A single judge bench of Justice Rajesh Dayal Khare passed the order on June 01, refusing Nandi's prayer for quashing proceedings in the aforesaid case and directing the magistrate concerned to "consider and decide" the case "expeditiously, strictly in accordance with law, without granting unnecessary adjournment to either of the parties".
Nandi, who is also a well-known industrialist of Allahabad, had moved the court challenging criminal proceedings initiated against him upon a complaint filed by Amar Nath Vaish, a wholesaler dealing in cement.
Vaish had lodged an FIR in Kotwali police station here alleging that Nandi, who was then holding a cabinet berth, had purchased cement from him in 2008 and issued a cheque of Rs 1.5 lakh which was "returned by the bank with the endorsement that the fund is insufficient".
The court rejected Nandi's application moved under under Section 482 of the Criminal Procedure Code observing "from the perusal of the material on record and looking into facts of the case, it can not be said that no offence is made out against the applicant".
Nandi had made his electoral debut in the 2007 assembly elections which also saw the Mayawati-led Bahujan Samaj Party assuming power in the state. He was inducted into the cabinet and given the key portfolios of institutional finance and stamp and judicial tax.
A devastating bomb attack in 2010 forced him to stay away from active politics for several months remaining a minister without a portfolio during his convalescence and later made the minister for homeopathy education. His political career received a setback when he lost the assembly elections this year from Allahabad (South) assembly seat.
